This Terms of Service Agreement (these "Terms") governs your use of the California Arrest APIs application programming interfaces, endpoints, data services, and any associated websites or developer portals (collectively, the "Service"). The Service is provided by California Arrest APIs. All data provided through the Service is obtained from public agencies pursuant to Public Records Requests. California Arrest APIs does not guarantee the accuracy, completeness, or timeliness of the data and is not responsible for errors or omissions. By accessing or using the Service, you agree to be bound by these Terms.

⚠️ DISPUTE RESOLUTION

THESE TERMS INCLUDE A WAIVER OF JURY TRIALS AND CLASS ACTIONS AND REQUIRE BINDING ARBITRATION ON AN INDIVIDUAL BASIS.

CHANGES TO TERMS

We may modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the updated Terms.

API ACCESS & USAGE

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service in accordance with these Terms.

You agree to:

  • Use the API only within your authorized usage limits.
  • Use the Service only for lawful purposes.
  • Not interfere with or disrupt the Service or its infrastructure.

    • You may not:

  • Use the Service for marketing, solicitation, or targeting individuals identified in the data.
  • Resell, redistribute, or sublicense the data without prior written consent.
  • Use the Service or data for training or improving artificial intelligence or machine learning models.
  • Reverse engineer, decompile, or attempt to extract source code.
  • Access the Service bots or automated means beyond permitted API usage.

API KEYS & SECURITY

You are responsible for maintaining the confidentiality of your API credentials. You are liable for all usage under your account. You must immediately notify us of any unauthorized use.

DATA USAGE RESTRICTIONS

All data provided:

  • Remains the property of California Arrest APIs or its licensors.
  • Is for internal use only unless otherwise authorized.
  • Must not be used in violation of privacy, data protection, or applicable laws.

    • PAYMENTS

    You agree to pay all fees associated with your use of the Service. Payments are processed through third-party providers. You authorize us to share necessary billing information with such providers.

    SERVICE AVAILABILITY

    We may modify, suspend, or discontinue the Service at any time without liability.

    TERMINATION

    We may suspend or terminate your access at any time for violation of these Terms or misuse of the Service.

    DISCLAIMER OF WARRANTIES

    THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." WE DISCLAIM ALL WARRANTIES, INCLUDING ACCURACY, RELIABILITY, AND FITNESS FOR A PARTICULAR PURPOSE.

    LIMITATION OF LIABILITY

    TO THE MAXIMUM EXTENT PERMITTED BY LAW, CALIFORNIA ARREST APIS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF DATA OR PROFITS.

    INDEMNIFICATION

    You agree to indemnify and hold harmless California Arrest APIs from any claims arising out of your use of the Service or violation of these Terms.

    GOVERNING LAW

    These Terms are governed by the laws of the State of California.

    ARBITRATION

    All disputes shall be resolved through binding arbitration in Sacramento, California, except where prohibited by law.

    MISCELLANEOUS

    These Terms constitute the entire agreement between you and California Arrest APIs regarding the Service.
